§ 173.15. Unsafe lead based paint work practices.

(a) The Department may inspect any premises which are the subject of a complaint of unsafe lead based paint work practices made pursuant to § 17- 179(b) of the Administrative Code.

(b) Such inspection shall include the premises where interim controls, or any other work disturbing lead based paint or paint that is presumed to be lead based paint pursuant to Article 14 of Subchapter 2 of Chapter 2 of Title 27 of the Administrative Code is in progress, and any other areas affected by the emission or release of leaded dust or debris as a result of such work.

(c) Upon verifying any such complaint, the Department may issue such orders as may be necessary, including, but not limited to, orders to stop work immediately; to clean any affected area of uncontained lead based paint debris and dust; to correct any unsafe conditions or work practices constituting a departure from the provisions of applicable law; and to require persons performing such work to submit a work plan prior to resuming work to demonstrate their ability and willingness to comply with the provisions of this Code, the Administrative Code or other applicable laws and regulations.

(d) Nothing contained in this section shall be construed to restrict the existing authority of the Department to enforce any other provision of law, including but not limited to any other provision of this Code, or to restrict the authority of the Department of Housing Preservation and Development to enforce any provision of the Housing Maintenance Code, or other applicable law.
